LU-01 — 2025–2026 Minnesota Legal Update for Direct Support Professionals

Minnesota's 2025 and 2026 legislative sessions changed the rules Direct Support Professionals work under every shift. This update walks DSPs through electronic visit verification (EVV) — which services must verify visits in real time, the 80% compliance threshold now in effect, and the live-in caregiver rules — plus the new pre-direct-contact drug and alcohol policy training deadline, the ban on requiring guardianship as a condition of service, the tightened limits on restricting service recipients' rights, new rights for children receiving services, the expanded definitions of abuse and financial exploitation under the Vulnerable Adults Act, modernized MAARC reporting, and the new illegal-remuneration (kickback) crime.
