Every person you support has a legal right to privacy — and as a direct support professional, you are one of the people most trusted to protect it. The Health Insurance Portability and Accountability Act, known as HIPAA, along with Minnesota’s own data privacy laws, sets clear boundaries around what health and personal information you can access, share, and discuss. Violating those boundaries — even accidentally — can result in serious consequences for you, your agency, and most importantly, the person you serve.

This course gives you a practical, plain-language understanding of HIPAA and data privacy as they apply specifically to your role in a 245D home care setting. You will learn what counts as protected health information, when you can and cannot share it, how to handle records and documentation safely, and what to do if a privacy breach occurs.

• What HIPAA is and why it applies to 245D home care agencies
• What counts as Protected Health Information (PHI) — and what surprises people
• The Minimum Necessary standard — sharing only what is needed
• Who you can and cannot share client information with — and when consent is required

• Minnesota-specific data privacy requirements for licensed providers
• Client rights regarding their own health information
